Turkey REACH Targeted for Last Quarter of 2016
Turkey could have its own version of the REACH Regulation in place by the last quarter of 2016.
Turkey’s Chemicals Registration, Evaluation, Authorisation and Restriction Regulation (KKDIK in Turkish), establishes authorization and restriction processes to control known chemicals of concern.
Registration will be required for substances manufactured or imported in volumes over 1 tonne. As with the European Union’s REACH Regulation, the ‘no data, no market’ rule will be applied, meaning compliance will be mandatory for companies wanting to bring their products into the country.
Some key points for the legislation include:
- Safety Data Sheets (SDS) must be in Turkish. This means global SDS creator tools will not work because they produce an SDS that is incomprehensible to end users in Turkey.
- Non-Turkish companies must use an only representative, that is a natural or legal person residing in Turkey, to create the SDS for Turkish importers.
- Enforcement is to be controlled by compliance checks and dossier evaluations by the Ministry of Environment and Urbanisation, which is designated as the competent authority under KKDIK.
- Data sharing is to take place through substance information exchange forums. Little detail or guidance is provided on the logistics and practicalities of data sharing within the KKDIK system.
The KKDIK will have an impact on international companies doing business in Turkey. Even companies with established EU REACH compliance programs will need to adjust to the KKDIK in order to comply with its Turkey-specific requirements.
